PROPOSED PRIVATE PLAN CHANGE P020

NOTIFIED: 10 NOVEMBER 2012
Waimakariri District Council has accepted for public notification privately
initiated District Plan change request P020 under clause 25 of the first
schedule of the Resource Management Act 1991.
Proposed Private Plan Change P020 seeks to rezone Lots 1, 2 and 3 DP
431485, Lots 4-7 DP 431485, Sec 1 SO 397393, and Lots 96-102, Pt Lots
103-105, Pt Lot 107, Lots 123-129 and Pt Lots 130-132 DP 713 from Rural
to Business 5. The rezoning covers an area of approximately 8 hectares
located at Kaiapoi in an area generally defined by State Highway 1, Smith
Street and the Kaiapoi River.
To enable this, Proposed Private Plan Change P020 introduces a new Outline
Development Plan into the District Plan and amends the associated maps in
conjunction with new objectives, policies, methods and rules. The changes
• Insert District Plan Map 170 (Kaiapoi Business 5 Zone Outline
• Amend District Plan Maps 102 and 104 to show the Business 5 Zone and
delete the localised flood area notation;
• Add new definitions food and beverage outlet , tenancy , trade supplier ,
automotive and marine supplier , farming and agricultural supplier ,
garden and landscaping supplier , and office furniture, equipment and
systems supplier to Chapter 1 - Definitions;
• Amend explanation of Policies 188.8.131.52, 184.108.40.206 and 220.127.116.11 to refer
to new Policy 18.104.22.168;
• Amend explanation of Policy 22.214.171.124 to describe the location of the
Business 5 Zone;
• Add new Environmental Results Expected to Chapter 16 (Business Zones)
as it applies to the Business 5 Zone;
• Amend explanation and methods of Policy 126.96.36.199 to describe the
Business 5 Zone;
• Add new Policy 188.8.131.52, reason and methods to provide for trade
supplier and large floor plate office activities in the Business 5 Zone;
• Add paragraph to Principle Reasons for Adopting Objectives, Policies and
Methods in regard to the Business 5 Zone;
• Amend Policy 184.108.40.206 to include the plan change area within the Kaiapoi
• Add new Rules 220.127.116.11, 18.104.22.168 and 22.214.171.124 to restrict the location
of access from Smith Street, require accessway formation, and exempt
the access point from intersection separation requirements;
• Add new Rule 126.96.36.199 to provide for joint off street parking by
• Amend Rule 188.8.131.52 (Table 31.1) to include the Business 5 Zone within
the 10m structure boundary setback from an arterial or strategic road;
• Amend Rules 184.108.40.206 and 220.127.116.11 to provide for a 15m height
maximum with exemptions;
• Amend 18.104.22.168 to provide for landscaping within the setback
requirements of Rule 22.214.171.124;
• Add Rule 126.96.36.199 to provide for connection to the stormwater
management system and not to locate outdoor storage within the
requirements of Rule 188.8.131.52 and 184.108.40.206;
• Amend Rule 31.4.1 (Discretionary Activities) to take into account
amended rule numbering;
• Add Rules 220.127.116.11 and 18.104.22.168 to provide for limited retail and office
• Add Rule 31.23 to provide for a non-complying activity status for Rules
22.214.171.124 and 126.96.36.199;
• Amend Rule 31.5.3 to include the erection of dwellinghouses as a non-

Proposed Private Plan Change P020 is available from the following Council
Service Centres and Libraries:
• Rangiora Service Centre, 215 High Street, Rangiora,
• Rangiora Library, 141 Percival Street, Rangiora,
• Kaiapoi Service Centre 24 Sewell Street,
• Kaiapoi Library, 9 Cass Street, Kaiapoi (entrance off Davie Street),
• Oxford Service Centre/Library, 34 Main Street, Oxford.

Any person may make a submission on this Private Plan Change. Submissions
must be in writing and in the format prescribed by Form 5 of the Resource
Management (Forms) Regulations 1991 or similar. Forms are available from
the Council Offices listed above and on the Council s website.
Once all submissions have been received, the Council will prepare and publicly
notify a summary of the submissions. All the submissions will be available for
public inspection. There will be an opportunity for anyone to make a further
submission in support of, or in opposition to, any of these submissions. A
Council hearing will then be arranged to consider all submissions, and
decisions will be made. Anyone who has made a submission will have the right
to attend the hearings and present his or her submission. Generally, anyone
who has made a submission also has the right of appeal against a Council
decision to the Environment Court.
Note: This Private Plan Change requests has no effect until the Council makes
any changes to the District Plan operative.
Submissions will close at 5.00 p.m. on Friday, 7 December 2012 at any
Council Service Centres listed above. Submissions may also be lodged on the
correct form via the Council s website. If you have any questions in relation
